Why did I receive an admonition from COPYTRACK?

You have received a letter from Copytrack admonishing you to pay for a post-license fee or cover compensation costs for a copyright infringement that you have been accused of. You are wondering whether you are facing a legitimate claim or whether this is a scam. Let us tell you that we have a legitimate claim against you for a copyright infringement that has taken place and that we will go to court representing our client to sue for damages that have created.

Photographs and all kinds of creative work are protected by copyright for over 70 years. While each country has its own copyright law, all countries protect the intellectual property of creators by allowing infringements to be sued in front of court. You need to have a license from the copyright owner to be allowed to use his or her work legally.

No. Deleting the image only ends further use. This does not change the fact that you have used the image in the past and must compensate the copyright holder for this. We will assert this claim for the copyright holder even if you have deleted the image. Deleting the images is therefore not sufficient and does not change our claim.

The copyright holder of the images is a client of Copytrack and has commissioned Copytrack exclusively to assert his rights. To this end, he transfers to Copytrack both the claims for damages arising from the copyright infringement and the right to grant subsequent licenses. Our client is very busy in his profession and does not have the time to chase people who are stealing his images online. He finds it a disgrace that people would do this and has commissioned us to enforce his legal claim.

Many of our clients sell their images through agencies. However, very few agencies tell our clients to whom they actually sold the picture. Therefore, it is not always clear to the photographer whether or not you have acquired the image legally or whether you are using it illegally. No. Although the rights holder is also entitled to a claim for omission against the image user, it can only be eliminated by submitting a declaration of omission with a penalty clause. Copytrack will refrain from this at first.

We calculate the fees based on the average price of the work of our client, geography, usage type, length of usage, damage, and image size. Failure to pay will lead to additional costs.
